 House set to vote to end Trump’s border wall ’emergency‘

WASHINGTON (Reuters) – The U.S. House of Representatives votes on Tuesday on a resolution to terminate President Donald Trump’s declaration of a national emergency to build a wall on the border with Mexico.

House Democrats introduced the resolution last week, challenging Trump’s assertion that he could use money to build the wall that Congress had appropriated for other purposes.

The resolution is expected to sail easily through the Democrat-controlled House. Action then moves to the Republican-majority Senate, where the measure’s future is uncertain even though it only requires a simple majority to pass.

Besides being another chapter in a long-running fight between Trump and Democrats over border security and immigration policy, Tuesday’s vote will be a test of constitutional separation of powers, as it is the House and Senate that primarily dictate spending priorities, not the president.

The No. 2 House Democrat, Representative Steny Hoyer, said at a press conference on Monday that he had traveled to the U.S.-Mexico border twice in the past few weeks.

“What I concluded is there is no crisis at the border. The issue … will be whether there is a crisis of our constitutional adherence,” Hoyer said.

Republican Senator Thom Tillis, in an op-ed published in Tuesday’s Washington Post, said he backed Trump on border security issues but would vote for the resolution because he “cannot justify providing the executive with more ways to bypass Congress.”

At least two other Republican senators, Susan Collins and Lisa Murkowski, have told the media they are likely to vote for the measure. For the resolution to pass the Senate, at least one more Republican vote would be needed, assuming all Democrats and two independents back it.

Trump, who declared the national emergency this month after Congress declined his request for $5.7 billion to help build a border wall, vowed last week to veto the measure if it passes both chambers.

Congress would then have to muster the two-thirds majority necessary – a high hurdle – to override the president’s veto for the measure to take effect.

A bipartisan group of 58 former national security officials issued a statement Monday saying there was no “factual basis” for Trump’s emergency declaration.

Lawmakers must not allow “any president (to) on a whim declare emergencies, simply because he or she can’t get their way in the Congress,” Senate Democratic Leader Chuck Schumer declared Monday.

Schumer warned that Trump’s emergency declaration “could cannibalize funding from worthy projects all over the country,” noting that the administration had not even decided yet what projects to take the funds from.

Some 226 House lawmakers are co-sponsoring the bill, including all but a handful of Democrats as well as one Republican, Justin Amash.

The issue is also in the courts. A coalition of 16 U.S. states led by California has sued Trump and top members of his administration to block his emergency declaration.

Congress this month appropriated $1.37 billion for building border barriers following a battle with Trump, which included a 35-day partial government shutdown – the longest in U.S. history – when agency funding lapsed on Dec. 22.

Air strike on Pakistan sparks celebrations in India, seen boosting Modi support

JAMMU/NEW DELHI, India (Reuters) – Indians took to the streets in celebration across the country on Tuesday after the government said it carried out air strikes inside Pakistan killing hundreds of militants in a training camp.The reaction may be a sign that support for Prime Minister Narendra Modi is surging months before a general election, pollsters said. Patriotism may be having a greater influence than concerns about low farm incomes and weak jobs growth.

India said air force jets hit a training camp of Jaish-e-Mohammad (JeM), the militant group that claimed credit for a Feb. 14 suicide bombing attack that killed Indian paramilitary police in Kashmir, a mountainous region also claimed by neighboring Pakistan.

“A very large number of Jaish-e-Mohammad terrorists” were killed, Indian Foreign Secretary Vijay Gokhale said.

Pakistan said there had been no casualties at all.

While the results of the strikes in the early hours of Tuesday were disputed, that didn’t stop many in India from believing their government’s version of events.

“Modi ji has finally done it”, said Sandeep Sharma, a driver in the Jammu region of India’s border state of Jammu and Kashmir, using an honorific for Modi. “There’s a lot of anger against Pakistan here.”

India’s opposition leaders, many of whom have banded together against the ruling Bharatiya Janata Party (BJP), congratulated the Indian Air Force (IAF), though they stopped short of praising Modi.

“I salute the pilots of the IAF,” Rahul Gandhi, leader of India’s main opposition Congress, said in a tweet.

In a village 100 metres from the Line of Control (LoC) that acts as the de facto border with Pakistan, men gathered around a bunker for security forces that is under construction and shouted slogans hailing India.

We will celebrate tonight,” one said, “We have lost so many of our villagers to Pakistani firing.”

Shelling across the LoC has occurred frequently over the past few years but incursions into the other country’s air space are rare – let alone an attack well into Pakistan.

Modi has been under pressure to retaliate since the suicide car bombing in Kashmir’s Pulwama, which India alleges was orchestrated by Pakistan’s intelligence agency, and tensions between the nuclear-armed neighbors have escalated in recent days.

Tuesday’s strike will not only boost Modi’s campaign in the election due by May, political analysts said, but also take the spotlight off economic issues for which the BJP has felt the heat.

“I think this is going to boost the electoral prospects of the BJP because people are generally in a celebration mood, that the government has been able to teach a lesson to Pakistan,” said Sanjay Kumar, director of the CSDS think-tank and a leading pollster.

The BJP lost a string of state elections late last year, after which opposition parties have attempted to form a coalition to take on Modi.

And although his ratings have dropped to their lowest-ever level, Modi remains the most popular leader in the country, an India Today poll showed last month.

“A large proportion of voters who had started drifting away from the BJP would come back to the fold,” Kumar said. “This all goes to the advantage of the BJP.”

India confirms air strikes inside Pakistan

Also many BJP supporters who had become disillusioned with the party would feel relief, said Bhawesh Jha, founder of CNX, one of India’s largest polling companies.

“… They will work hard to ensure the victory of Narendra Modi,” Jha said. “Since this is happening so close to the election, Pulwama will be the biggest issue.”

As news of the strike emerged, India’s television channels flashed patriotic slogans and headlines including TIMES NOW’s “Proud moment for undefeatable Bharat”, using a Hindi word for India.

Some recalled the so-called “surgical strike” on suspected militant camps in Pakistan in 2016 after an attack by militants on an Indian army camp.

By the afternoon, shortly after India’s foreign ministry provided some details of the strike, Modi spoke to a large crowd at an election rally in Churu, in the western state of Rajasthan.

“I can assure you that India is in safe hands,” he said from a podium placed before a collage of photographs of members of security forces who had died in Kashmir this month.

“Modi, Modi, Modi,” the crowd shouted back.

Pakistan vows retaliation after India’s airstrikes on alleged militant camps

India and Pakistan may be on the brink of yet another violent conflict after Indian jets launched strikes on suspected militant camps on Pakistani soil. Many fear an escalation could be devastating for the entire region.

India said on Tuesday that its air force had carried out strikes inside Pakistan, targeting camps run by the Jaish-e-Mohammad (JeM) terrorist group. New Delhi said it had managed to kill a “very large number” of fighters in the operation.

“A very large number of Jaish-e-Mohammed terrorists, trainers, commanders and groups of jihadis who were being trained for fidayeen [suicide] action” have been killed, India’s Foreign Secretary Vijay Gokhale said at a press conference.

Security officials in India told DW on condition of anonymity that the operation involved Mirage 2000 aircraft, which flew across the Line of Control (LoC) and dropped 1,000 kilograms of bombs. The Mirage 2000 is a French-made single-engine fourth-generation fighter jet, manufactured by Dassault Aviation.

JeM claimed responsibility for a recent deadly attack in Kashmir that claimed the lives of at least 40 Indian troops. India said the camps in Balakot, which was the target of Tuesday’s strike, were headed by Maulana Yusuf Azhar or Ustad Ghauri, the brother-in-law of JeM chief Masood Azhar.

Following the air strikes, speaking at an election rally in the northern state of Rajasthan, Indian Prime Minister Narendra Modi said, “The country is in safe hands.”

“I pledge on this soil, I will not let the country die, I will not let the country stop. I will not let the country bend. It is my promise to Mother India; I will protect your honor.”

The move by the Indian air force marks a significant escalation, as the last time Indian military jets carried out strikes in Pakistan was during the 1971 war for the liberation of Bangladesh. And this marks the first such strike since India and Pakistan became nuclear powers. Even during the armed conflict between the two sides in Kashmir’s Kargil district in 1999, air incursions were described as inadvertent and not specifically planned by the air force.

In September 2016, however, the Indian military said it had carried out “surgical strikes” on militants across the de-facto border in the disputed Kashmir region. This was days after armed insurgents attacked an army base in India-administered Kashmir, killing 18 soldiers. At that time, Pakistan dismissed India’s claims about the strikes.

Criticism from Pakistan

On Tuesday, while India claimed it had successfully launched the attack against JeM camps inside Pakistani territory, Islamabad denied New Delhi’s assertions, saying that Pakistan’s air force managed to thwart India’s attempts.

In a tweet, Major-General Asif Ghafoor, the director general of Pakistan’s Inter-Services Public Relations, said: “Indian Air Force violated Line of Control. Pakistan Air Force immediately scrambled. Indian aircrafts gone back.

Two historic rivals are at their closest to open conflict in years, after Indian jets carried out strikes on Pakistani territory on Tuesday. But how do the subcontinental powers stack up against each other?

Economy & population

While Karachi presents itself as an equal to Delhi in their diplomatic dealings, India’s advantage in economic size ($2.689 trillion nominal GDP versus $307 billion in 2018) and population (1.3 billion against 200 million) is proportionately translated to military dominance that Pakistan can only counter by spending financial resources it can ill afford.

India’s military budget last year was $58 billion dollars, according to the UK-based International Institute for Strategic Studies, almost as large as Russia’s, and good enough for fifth place. In contrast Pakistan spent $11 billion, which was a bigger share of its budget.

Army, air force & navy

Pakistan compensates by fielding a relatively large standing army, with 560,000 troops, compared to India’s 1.2 million standing army. Though, if a hypothetical full-scale war were to occur, it could call on 300 million draft-age men, six times more than the manpower pool available to its northern neighbor.

India has a tank capacity of about 3,500, about 1,000 more than Pakistan. The Russian-made T-90 forms the bulk of the force available to 60-year-old chief of army staff Bipin Rawat, while his Pakistani counterpart 58-year-old Qamar Javed Bajwa commands mostly imported Chinese vehicles.

Similarly, India operates nearly 10,000 artillery units, compared to fewer than 5,000 for Pakistan, and with 3,100 infantry carriers has double the amount of its rival.

Pakistan operates 425 combat aircraft, an eclectic mix of French, US, Chinese and joint-produced jets. India owns over 800 planes ready for combat, though much of their fleet is composed of Cold War-era Soviet-made jets like the MiG-21 and MiG-27 that are close to obsoletion even with modern modifications. The bulk of its firepower comes from the more recent Russian-made Su-30, with well over 200 such planes available to the Indian air force.

Analogously, India owns a significantly more numerous, sizeable and sophisticated navy capability, which is to be expected from a country with a coastline that is ten times longer. But in any case, just as in the previous two conflicts between the two countries, any naval conflict would likely be an afterthought, with the inland region of Kashmir the focal point.

Nuclear capabilities

Realizing its, probably insurmountable, disadvantages, Pakistan has poured much of its money into creating a nuclear deterrent. Both countries conducted their first official weapons tests in 1998, and according to the Stockholm International Peace Research Institute (SIPRI) Pakistan has built up an arsenal of 140-150 warheads, more than India’s 130-140. India, however, enjoys superior delivery mechanism capacity, with its Agni-3 rockets capable of hitting targets 5,000km (3,107 miles) away. In contrast Pakistan’s longest-range Shaheen 2 can strike 2,000km targets.

But even with these limitations, and taking into account the intercepting capacities of each nation, in the case of total war, each would be able to inflict millions of casualties on each other’s densely populated cities within hours.

 

Survival of the Richest

All Are Equal, Except Those Who Aren’t

Like a gilded coating that makes the dullest things glitter, today’s thin veneer of political populism covers a grotesque underbelly of growing inequality that’s hiding in plain sight. And this phenomenon of ever more concentrated wealth and power has both Newtonian and Darwinian components to it.

In terms of Newton’s first law of motion: those in power will remain in power unless acted upon by an external force. Those who are wealthy will only gain in wealth as long as nothing deflects them from their present course. As for Darwin, in the world of financial evolution, those with wealth or power will do what’s in their best interest to protect that wealth, even if it’s in no one else’s interest at all.

In George Orwell’s iconic 1945 novel, Animal Farm, the pigs who gain control in a rebellion against a human farmer eventually impose a dictatorship on the other animals on the basis of a single commandment: “All animals are equal, but some animals are more equal than others.” In terms of the American republic, the modern equivalent would be: “All citizens are equal, but the wealthy are so much more equal than anyone else (and plan to remain that way).”

Certainly, inequality is the economic great wall between those with power and those without it.

As the animals of Orwell’s farm grew ever less equal, so in the present moment in a country that still claims equal opportunity for its citizens, one in which three Americans now have as much wealth as the bottom half of society (160 million people), you could certainly say that we live in an increasingly Orwellian society. Or perhaps an increasingly Twainian one.

After all, Mark Twain and Charles Dudley Warner wrote a classic 1873 novel that put an unforgettable label on their moment and could do the same for ours. The Gilded Age: A Tale of Today depicted the greed and political corruption of post-Civil War America. Its title caught the spirit of what proved to be a long moment when the uber-rich came to dominate Washington and the rest of America. It was a period saturated with robber barons, professional grifters, and incomprehensibly wealthy banking magnates. (Anything sound familiar?) The main difference between that last century’s gilded moment and this one was that those robber barons built tangible things like railroads. Today’s equivalent crew of the mega-wealthy build remarkably intangible things like tech and electronic platforms, while a grifter of a president opts for the only new infrastructure in sight, a great wall to nowhere.

In Twain’s epoch, the U.S. was emerging from the Civil War. Opportunists were rising from the ashes of the nation’s battered soul. Land speculation, government lobbying, and shady deals soon converged to create an unequal society of the first order (at least until now). Soon after their novel came out, a series of recessions ravaged the country, followed by a 1907 financial panic in New York City caused by a speculator-led copper-market scam.

From the late 1890s on, the most powerful banker on the planet, J.P. Morgan, was called upon multiple times to bail out a country on the economic edge. In 1907, Treasury Secretary George Cortelyou provided him with $25 million in bailout money at the request of President Theodore Roosevelt to stabilize Wall Street and calm frantic citizens trying to withdraw their deposits from banks around the country. And this Morgan did — by helping his friends and their companies, while skimming money off the top himself. As for the most troubled banks holding the savings of ordinary people? Well, they folded. (Shades of the 2007-2008 meltdown and bailout anyone?)

The leading bankers who had received that bounty from the government went on to cause the Crash of 1929. Not surprisingly, much speculation and fraud preceded it. In those years, the novelist F. Scott Fitzgerald caught the era’s spirit of grotesque inequality in The Great Gatsby when one of his characters comments: “Let me tell you about the very rich. They are different from you and me.” The same could certainly be said of today when it comes to the gaping maw between the have-nots and have-a-lots.

Income vs. Wealth

To fully grasp the nature of inequality in our twenty-first-century gilded age, it’s important to understand the difference between wealth and income and what kinds of inequality stem from each. Simply put, income is how much money you make in terms of paid work or any return on investments or assets (or other things you own that have the potential to change in value). Wealth is simply the gross accumulation of those very assets and any return or appreciation on them. The more wealth you have, the easier it is to have a higher annual income.

Let’s break that down. If you earn $31,000 a year, the median salary for an individual in the United States today, your income would be that amount minus associated taxes (including federal, state, social security, and Medicare ones). On average, that means you would be left with about $26,000 before other expenses kicked in.

If your wealth is $1,000,000, however, and you put that into a savings account paying 2.25% interest, you could receive about $22,500 and, after taxes, be left with about $19,000, for doing nothing whatsoever.

To put all this in perspective, the top 1% of Americans now take home, on average, more than 40 times the incomes of the bottom 90%. And if you head for the top 0.1%, those figures only radically worsen. That tiny crew takes home more than 198 times the income of the bottom 90% percent. They also possess as much wealth as the nation’s bottom 90%. “Wealth,” as Adam Smith so classically noted almost two-and-a-half-centuries ago in The Wealth of Nations, “is power,” an adage that seldom, sadly, seems outdated.

A Case Study: Wealth, Inequality, and the Federal Reserve

Obviously, if you inherit wealth in this country, you’re instantly ahead of the game. In America, a third to nearly a half of all wealth is inherited rather than self-made. According to a New York Times investigation, for instance, President Donald Trump, from birth, received an estimated $413 million (in today’s dollars, that is) from his dear old dad and another $140 million (in today’s dollars) in loans. Not a bad way for a “businessman” to begin building the empire (of bankruptcies) that became the platform for a presidential campaign that oozed into actually running the country. Trump did it, in other words, the old-fashioned way — through inheritance.

 

Can a sitting U.S. president face criminal charges?

WASHINGTON (Reuters) – The U.S. Constitution explains how a president can be removed from office for “high crimes and misdemeanors” by Congress using the impeachment process. But the Constitution is silent on whether a president can face criminal prosecution in court, and the U.S. Supreme Court has not directly addressed the question.

The question looms large with Special Counsel Robert Mueller preparing a report on his investigation into Russia’s role in the 2016 U.S. election, whether President Donald Trump’s campaign conspired with Moscow and whether Trump unlawfully sought to obstruct the probe.

The U.S. Justice Department has a decades-old policy that a sitting president cannot be indicted, indicating that criminal charges against Trump would be unlikely, according to legal experts.

Starr did not indict Clinton in his investigation involving the president’s relationship with a White House intern named Monica Lewinsky, but lawyers in his office concluded he had the authority to do so, according to a once-secret internal memo made public by the New York Times in 2017.

After the independent counsel statute under which Starr was named expired in 1999, the Justice Department devised procedures governing the appointment of special counsels to handle certain investigations. Mueller was named after Trump fired FBI Director James Comey, who had been overseeing the agency’s Russia probe.

The U.S. Justice Department has a decades-old policy that a sitting president cannot be indicted, indicating that criminal charges against Trump would be unlikely, according to legal experts.

Here is an explanation of the rationale behind the Justice Department policy and whether it applies to Mueller.

WHAT IS THE JUSTICE DEPARTMENT POLICY?

In 1973, in the midst of the Watergate scandal engulfing President Richard Nixon, the Justice Department’s Office of Legal Counsel adopted in an internal memo the position that a sitting president cannot be indicted. Nixon resigned in 1974, with the House of Representatives moving toward impeaching him.

“The spectacle of an indicted president still trying to serve as Chief Executive boggles the imagination,” the memo stated.

The department reaffirmed the policy in a 2000 memo, saying court decisions in the intervening years had not changed its conclusion that a sitting president is “constitutionally immune” from indictment and criminal prosecution. It concluded that criminal charges against a president would “violate the constitutional separation of powers” delineating the authority of the executive, legislative and judicial branches of the U.S. government.

“The indictment or criminal prosecution of a sitting President would unconstitutionally undermine the capacity of the executive branch to perform its constitutionally assigned functions,” the memo stated.

The 1973 and 2000 memos are binding on Justice Department employees, including Mueller, according to many legal experts. Mueller was appointed in May 2017 by the department’s No. 2 official Rod Rosenstein.

But some lawyers have argued that the nation’s founders could have included a provision in the Constitution shielding the president from prosecution, but did not do so, suggesting an indictment would be permissible. According to this view, immunity for the president violates the fundamental principle that nobody is above the law.

Nixon himself in 1977 offered an opposite view when he told interviewer David Frost, “Well, when the president does it that means that it is not illegal.”

COULD MUELLER INDICT TRUMP DESPITE THE EXISTING POLICY?

Possibly. The Justice Department regulations governing Mueller’s appointment allow him to deviate from department policy in “extraordinary circumstances” with the approval of the U.S. attorney general, the nation’s top law enforcement official. Trump appointee William Barr currently holds that post.

Some legal experts have suggested Mueller could invoke this exception if he has uncovered serious wrongdoing and lacked confidence in the ability of the divided Congress to hold Trump accountable. Some lawyers also have said Mueller is not bound by the 1973 and 2000 memos because he is not a typical employee of the department.

Ken Starr, who investigated President Bill Clinton in the 1990s in the somewhat different role of independent counsel, in 1998 conducted his own analysis of the question of whether a sitting president can be indicted, indicating he did not consider the 1973 Justice Department memo binding on him.

Starr did not indict Clinton in his investigation involving the president’s relationship with a White House intern named Monica Lewinsky, but lawyers in his office concluded he had the authority to do so, according to a once-secret internal memo made public by the New York Times in 2017.

COULD TRUMP BE REMOVED FROM OFFICE AND THEN PROSECUTED?

Yes. There is no debate over whether a former president can be indicted for conduct that occurred while in office. In fact, President Gerald Ford, who succeeded Nixon after his resignation, was mindful of this when he granted “a full, free, and absolute pardon unto Richard Nixon for all offenses against the United States which he, Richard Nixon, has committed or may have committed.”

The statute of limitations – restricting the time within which legal proceedings such as a prosecution may be brought – may work to Trump’s benefit if he is re-elected in 2020 and serves a full two four-year terms as president until January 2025.

Many federal crimes have a five-year statute of limitations, meaning prosecutors have five years from the date the conduct at issue occurred to bring an indictment. That means criminal charges against a re-elected Trump could be time-barred.

Some lawyers have said that, as a matter of fairness, the normal rules on timeliness of charges should not apply to the president. The issue potentially could be resolved in the courts.

The CIA Confessions: The Crowley Conversations

On October 8th, 2000, Robert Trumbull Crowley, once a leader of the CIA’s Clandestine Operations Division, died in a Washington hospital of heart failure and the end effects of Alzheimer’s Disease. Before the late Assistant Director Crowley was cold, Joseph Trento, a writer of light-weight books on the CIA, descended on Crowley’s widow at her town house on Cathedral Hill Drive in Washington and hauled away over fifty boxes of Crowley’s CIA files.

Once Trento had his new find secure in his house in Front Royal, Virginia, he called a well-known Washington fix lawyer with the news of his success in securing what the CIA had always considered to be a potential major embarrassment.

Three months before, on July 20th of that year, retired Marine Corps colonel William R. Corson, and an associate of Crowley, died of emphysema and lung cancer at a hospital in Bethesda, Md.

After Corson’s death, Trento and the well-known Washington fix-lawyer went to Corson’s bank, got into his safe deposit box and removed a manuscript entitled ‘Zipper.’ This manuscript, which dealt with Crowley’s involvement in the assassination of President John F. Kennedy, vanished into a CIA burn-bag and the matter was considered to be closed forever.

The small group of CIA officials gathered at Trento’s house to search through the Crowley papers, looking for documents that must not become public. A few were found but, to their consternation, a significant number of files Crowley was known to have had in his possession had simply vanished.

When published material concerning the CIA’s actions against Kennedy became public in 2002, it was discovered to the CIA’s horror, that the missing documents had been sent by an increasingly erratic Crowley to another person and these missing papers included devastating material on the CIA’s activities in South East Asia to include drug running, money laundering and the maintenance of the notorious ‘Regional Interrogation Centers’ in Viet Nam and, worse still, the Zipper files proving the CIA’s active organization of the assassination of President John Kennedy..

A massive, preemptive disinformation campaign was readied, using government-friendly bloggers, CIA-paid “historians” and others, in the event that anything from this file ever surfaced. The best-laid plans often go astray and in this case, one of the compliant historians, a former government librarian who fancied himself a serious writer, began to tell his friends about the CIA plan to kill Kennedy and eventually, word of this began to leak out into the outside world.

The originals had vanished and an extensive search was conducted by the FBI and CIA operatives but without success. Crowley’s survivors, his aged wife and son, were interviewed extensively by the FBI and instructed to minimize any discussion of highly damaging CIA files that Crowley had, illegally, removed from Langley when he retired. Crowley had been a close friend of James Jesus Angleton, the CIA’s notorious head of Counterintelligence. When Angleton was sacked by DCI William Colby in December of 1974, Crowley and Angleton conspired to secretly remove Angleton’s most sensitive secret files out of the agency. Crowley did the same thing right before his own retirement, secretly removing thousands of pages of classified information that covered his entire agency career.

Known as “The Crow” within the agency, Robert T. Crowley joined the CIA at its inception and spent his entire career in the Directorate of Plans, also know as the “Department of Dirty Tricks,”: Crowley was one of the tallest man ever to work at the CIA. Born in 1924 and raised in Chicago, Crowley grew to six and a half feet when he entered the U.S. Military Academy at West Point in N.Y. as a cadet in 1943 in the class of 1946. He never graduated, having enlisted in the Army, serving in the Pacific during World War II. He retired from the Army Reserve in 1986 as a lieutenant colonel. According to a book he authored with his friend and colleague, William Corson, Crowley’s career included service in Military Intelligence and Naval Intelligence, before joining the CIA at its inception in 1947. His entire career at the agency was spent within the Directorate of Plans in covert operations. Before his retirement, Bob Crowley became assistant deputy director for operations, the second-in-command in the Clandestine Directorate of Operations.

Bob Crowley first contacted Gregory Douglas in 1993 when he found out from John Costello that Douglas was about to publish his first book on Heinrich Mueller, the former head of the Gestapo who had become a secret, long-time asset to the CIA. Crowley contacted Douglas and they began a series of long and often very informative telephone conversations that lasted for four years. In 1996, Crowley told Douglas that he believed him to be the person that should ultimately tell Crowley’s story but only after Crowley’s death. Douglas, for his part, became so entranced with some of the material that Crowley began to share with him that he secretly began to record their conversations, later transcribing them word for word, planning to incorporate some, or all, of the material in later publication.

RTC: Hello, Gregory. Have a nice Christmas?

GD: Wonderful. I got a sled, some bunny slippers, a silencer for my shotgun, a pornographic Bible, three pair of socks that were too small and a dead turtle. Yourself?

RTC: Somehow, I don’t believe you. Christmas was fine here. I take it you did not have an extensive Christmas.

GD: The rabbit died and we were in deep mourning. But then we ate it and felt much better.

RTC: I could send a sympathy card.

GD: Just flush it down the loo. It might meet up with what’s left of the rabbit. Robert, to be serious, you said that Corson did not like Mark Lane. He represented Carto in a lawsuit and I was wondering what was the reason for the bad feeling?

RTC: My God, Gregory, this is like an old auntie’s sewing circle. Everyone here hates everyone else, tells lies, sticks out their tongues at each other and acts like small children. There was a lawsuit of the Keystone Cops type. Victor Marchetti, who used to be one of ours but got booted out, wrote an article for the Spotlight paper saying that Hunt had been in Dallas on the day Kennedy was shot. He was. Hunt sued the paper and got a judgment. The paper fought back and got Mark Lane to defend them.

GD: The Oswald lawyer?

RTC: The same. So they went back and forth. Marchetti is a fat slob who thinks he is very important when we who really know him consider him to be a chattering nut. Hunt is grossly incompetent but the reason why Corson hates Lane and everyone else, is that Marchetti claimed he got this information about Hunt in Dallas on November 22nd from Corson. Corson got dragged over the coals by Lane and clearly was proved to be a liar. However, there was a third person there when Corson told his little story to Marchetti and that’s what nailed him. Poor Bill. He always has to put his oar in, needed or not.

GD: Well, he told Kimmel that he knew some secret British soldier who told Corson about the Roosevelt/Churchill conversation. Corson claimed he backed it up. Kimmel went for this like a duck after a June bug, but I can’t believe it. Who was this mysterious witness? Corson said his lips were sealed.

RTC: Too bad that isn’t true.

GD: Back and forth. I know Corson has lectured me on a subject that I knew far better that he did but I just kept quiet and acted impressed. Didn’t he get court-martialed?

RTC: My God, Gregory, don’t ever go into that one. Look, these people like Bill and Trento, Marchetti and the rest of them, are like squirrels in the park running around begging nuts from the public. This is the Beltway, Gregory. It’s a hot house. Someone sees the President from about two hundred feet away, driving past in his armored limousine and then tells his friends that he had a chance to talk to the President that afternoon and the President told him….and that’s how it goes. Trento thinks he is a brilliant writer, Bill thinks he’s a mover and shaker, Marchetti sees himself as a secret agent and Hunt has just enough sense to put on his pants before going outside to get the paper. These are the hangers-on, Gregory, the wannabes as the current generation calls them.

GD: Ah, Robert, but you were actually there, you knew from doing it. The sun versus the moon. The moon reflects the glory of another. Does that role make you happy?

RTC: It makes me sad sometimes. And they run around acting like old women. Chatter, chatter, boast, back-stab, strut and eventually die. We all die, Gregory, but some take a long time to do it. I’m pleasant with them because perhaps they can help me but I am giving up with most of them. I thought Costello would be a good outlet but I gave up on him long before he died last year. Trento thinks he’s a great intelligence writer but he reminds me of a wino rooting around in old dumpsters for chicken bones. Bill hints at great secrets that only he knows and Hunt is a bumbling idiot and we should have done him instead of his wife. Marchetti is a little bit of all of them. If you listen to them, Gregory, they will convince you that big black cars drive up in front of their homes, every evening, and give them briefcases full of very secret papers. You know the types.

GD: I do, Robert, I really do. I love it when one of your pinheads starts telling me about German intelligence. Oh yes, and what about Nosenko?

RTC: A Russian double agent that Angleton mismanaged.

GD: Was Angleton Italian?

RTC: No, half Mexican. He spoke wop from his father, having lived there and sold cash registers but he was a Mexican. He was well-connected with the mob, though.

GD: Mueller told me about Boris Pash…

RTC: That asshole. A gym teacher with more dreams of glory.

GD: Heini said that Pash tried to kill the Italian Communist leader.

RTC: Togliatti. Yes, but he missed. They always miss, Gregory.

GD: I have an Irish friend who never does. He prefers a knife but bombs will do very well.

RTC: I think you mentioned him. Mountbatten?

GD: The same. Now that’s a professional. And he doesn’t talk like the rest of them.

RTC: Real professionals never do.

GD: So if we both agree on what constitutes a professional agent, how do you analyze Corson, Kimmel, Marchetti, Trento and the others? Are they agents? Kimmel works for the FBI, Marchetti used to work for your people and the others?

RTC: What we have there is the wannabe club, Gregory. All of them think they are important people and, because they have, or have had, connections with the intelligence community, they begin to feel, somehow, that they are possessors of the secrets that others do not have. This elevates them from boredom and real obscurity and makes them believe that they are privy to those who really do walk in the corridors of power. I am the one, pardon the vanity, with the secrets and I am the one who walked once in the corridors of power so they gather around me, snapping up any little bit of information I choose to drop. There are many things I would like people I know, such as my family, to know about. I would like not to leave a legacy of mystery and negativity behind me. I know Corson and the others would like to have a private club type of inner knowledge, to sit around the fire solemnly talking about great secrets they have known. Never happen. When I go, they go. It’s that basic. I had thought once to cultivate Costello and let him speak for me but I gave up on him after his visit with you. The man was brittle, opinionated and as blind as a bat. Kimmel is an establishment man with no creative juices, Corson runs around barking like one of those obnoxious little Mexican dogs that were once raised for food, Marchetti reminds me of a drunken little rat running around in a barn, trying to get out. And when he does get out, he runs around outside trying to get back in. Trento and his wife are delusional and self important and love to mix it up with losers and never-could-have-beens.

GD: Basking, like the moon, in reflected glory.

RTC: Absolutely. And these are at the top of the rank amateur clubs. Down below them, we find the “experts” and the “researchers” who represent the bottom of the pyramid. They are the ones who scribble, jabber and strut. They look upwards to the top for the voices of the masters. They all feed on each other, Gregory. Their little worlds are all they have and if someone like you, especially someone like you, comes along, they loathe, fear and despise you. You see, you are the real thing and they are just wearing Halloween costumes and they know it. After Costello returned from his visit with you and spent hours telling me how terrible and unpleasant you were, I put this down to simple jealousy and thought that perhaps I might look into you myself. And that’s why we’re talking right this very moment.

GD: Thank you for your approval, Robert. I agree with you, but they are wearing the gold-braided clown suits and go to clubs and meetings and, like old peacocks, preen endlessly. What you tell me I already know, Robert, but short of grabbing them by their throats and banging their heads against the wall, there isn’t much I can do…

RTC: Except to out-produce them, Gregory. And they know you can do it and they hate you for it. A week does not go by without my getting some kind of a phone call about what a terrible, evil person you are and warning me never to talk with you. Notice how impressed I have been with these dire warnings. But please make my life a little easier in my old age by not quoting me to any of these cheap hustlers. If they really get it into their heads that I am being informative to you, they will call me every other day, warn Greg and Emily to protect me from you and then do everything in their shabby little power to trash you. Do not, and I repeat, do not trust any of them, ever. I think we understand this all, don’t we?

GD: Oh, yes. I never trusted these sort anyway. They remind me of old aunties or, even worse, academics. Both of them gossip, chatter, denigrate everyone not present and can’t sleep well at night unless they feel they have damaged someone else that day. They see themselves as giants and, in fact, they are small, chattering mice. But, and I am sure you know all about this, we have to put up with them in order to get along with the really important matters. Don’t worry about making myself vulnerable to these types. It ends up that they make themselves vulnerable to me in the end. What is the saying? Out of nothing, nothing is made.

Countrywide: Subprime Kings and the MERS scam

Many factors combined to create the current housing crisis in the United States.

Low interest rates after the 2001 stock market crash spurred the housing boom. Housing prices skyrocketed above historic trendlines. People were duped into thinking prices would rise forever, but it was inevitable that the housing bubble would burst, and houses would suddenly be worth a lot less. With house prices falling, lots of people are now finding they owe more than their house is worth. This problem is exacerbated by predatory loan arrangements that have left millions facing suddenly rising mortgage payments.

A lot of people and corporations deserve blame for this state of affairs.

Instead of warning consumers about the housing bubble – which would have gone a long way to counter the excessive price run-ups – then-Federal Reserve Chair Alan Greenspan denied a bubble was occurring.

Wall Street firms created exotic investment instruments that made possible the purchase and trading of large numbers of mortgages. This created conditions so that banks and initial lenders took less care in issuing mortgages – since they wouldn’t be responsible for mortgages gone bad. The Wall Street firms not only sold these instruments to duped investors, they took on major liabilities on their own – even though it was obvious the housing bubble would have to burst.

Rating agencies like Moody’s and Standard & Poor’s, which evaluated the riskiness of these new mortgage investment instruments, failed utterly. The housing bubble meant mortgage investments were sure to lose money, but the ratings agencies gave them top ratings anyway. Along with the “innovation” of the Wall Street firms, the ratings agencies helped maintain a market that dramatically exacerbated, and to a considerable degree may have created, the housing bubble.

Financial bubbles create an incentive for criminal and shady activity. Just like the stock bubble of the late 1990s created the climate for Enron and dozens of other companies to cook their books, the housing bubble created incentives for predatory lenders to exploit consumers.

The predatory lenders offered low rates, at least at first. Rates would rise later, but the lenders said that – because home prices were rising so fast and would continue to do so – borrowers could always refinance with a new loan.

The biggest of the predatory lenders was Countrywide, a mortgage lender acquired by Bank of America in January 2008. The company and its CEO, Angelo Mozilo, made a bundle, while setting up thousands and thousands of families for financial ruin.

“Over the past few years,” says Martin Eakes of the Center for Responsible Lending, “by steering millions of people into bad loans, Countrywide has been the largest rogue mortgage lender in the country. According to Countrywide’s own data, more than 80 percent of its exotic adjustable-rate loans were made to borrowers that do not meet current banking standards. Countrywide knew that these homeowners would not be able to make their monthly loan payments after dramatic payment increases became effective.”

The Center for Responsible Lending has compiled a dossier on Countrywide’s irresponsible practices, presented in a report, “Unfair and Unsafe.” Its devastating report, based on customer complaints, lawsuits, regulatory actions, news accounts, government reports and company documents, shows how Countrywide engaged in rampant wrongdoing:

Predatory lending. “Lawsuits filed around the country have accused Countrywide of preying on borrowers through a variety of unfair and fraudulent tactics that have siphoned equity out of their homes and pushed many into foreclosure,” notes “Unfair and Unsafe.” “Borrowers and regulators have accused the company of: steering borrowers with good credit into higher-cost ‘subprime’ loans; gouging minority borrowers with discriminatory rates and fees; working in cahoots with mortgage brokers who use bait-and-switch tactics to land borrowers into loans they can’t afford; targeting elderly and non-English-speaking borrowers for abusive loans; and packing loans with inflated and unauthorized fees.”

In one lawsuit, Albert Zacholl, a 74-year-old man living in Southern California, alleges that Countrywide and a pair of mortgage brokers “cold-called and aggressively baited” him. They promised him $30,000 cash, a mortgage that would replace his previous mortgage (which was leaving him owing more each month) and a monthly payment that would not exceed $1,700. Zacholl told the brokers that his income consisted of a pension of $350 a month and Social Security payments of $958, and that with help from his son, he could afford a mortgage up to $1,700. According to the lawsuit, the broker falsified his loan application by putting down an income of $7,000 a month, and then arranged for a high-interest mortgage that required him to pay more than $3,000 a month (and failed to deliver the $30,000 cash payment). The motivation for the scam, according to the lawsuit, was to collect $13,000 in fees.

In court papers, the Center for Responsible Lending reports, Countrywide responded that Zacholl “consented to the terms of the transaction” and that any problems were the result of his own “negligence and carelessness.”

Dangerous products.

Countrywide has been a leader in pushing unsound mortgage terms. These include “exploding” subprime adjustable rate mortgages – with reasonable interest rates in the first year that jump in subsequent years, often by as much as 30 percent to 50 percent.

Conflicts of interest.

“Countrywide has created a corporate structure designed to allow its subsidiaries to work hand-in-hand in squeezing borrowers with excessive fees and penalties,” according to “Unfair and Unsafe.” Countrywide affiliates handle appraisals, credit reports, flood certifications and other documentation for new loans; provide “force-placing” insurance for borrowers whose homeowners insurance has lapsed; and serve as a foreclosure trustee. The interconnections enable Countrywide to charge high fees, and deny borrowers the benefit of third parties’ independent judgment and independent interests.

Broken promises on loan modifications.

The company has a history of failing to fully live up to its promises to help borrowers keep their homes by modifying onerous loans, according to “Unfair and Unsafe.” The report cites a Fall 2007 Credit Suisse review that ranked Countrywide as one of the mortgage lenders least willing to adjust loan terms.

Countrywide says it is committed to working out fair arrangements to keep homeowners in their houses. In December, it entered into an arrangement with the community group ACORN designed to help subprime borrowers.

“During the first 11 months of 2007, Countrywide helped more than 69,000 customers retain their homes through solutions such as loan modifications, long-term repayment plans, special forbearance and other options,” says Steve Bailey, a Countrywide senior managing director of loan administration. “Regardless of the reason for the payment difficulties, Countrywide wants to try to find reasonable solutions for our borrowers.”

Abusive loan servicing.

Borrowers claim that Countrywide has engaged in sloppy and  fraudulent loan servicing that has produced unwarranted fees and foreclosures.

With the collapse of the housing market in 2007, Countrywide’s fortunes turned, its mortgage-backed securities plummeted in value, and the company seemed on the edge of bankruptcy. In January 2008, Bank of America agreed to buy the company.

Do not weep for company co-founder and long-time CEO Angelo Mozilo, however. Mozilo grabbed compensation worth $185 million from 2002-2006, according to an analysis by the U.S. House of Representatives Committee on Oversight and Government Reform. Between November 2006 and December 2007, Mozilo sold $150 million in stock – effectively jumping from a sinking corporate ship for which he was supposedly at the helm, or at least on the captain’s deck.

“Particularly, the discrepancy between Mr. Mozilo’s compensation and Countrywide’s performance is striking,” concludes the Oversight Committee analysis. “In 2007, Countrywide announced a $1.2 billion loss in the third quarter and an additional loss of $422 million in the fourth quarter.” By the end of the year, the company’s stock fell 80 percent from its February peak. “During the same period, Mr. Mozilo was paid $1.9 million in salary, received $20 million in stock awards contingent upon performance, and sold $121 million in stock.”

Mozilo retired as CEO in 2006, remaining as company chair and an employee. The House Oversight Committee analysis shows that his compensation contract, taking effect in 2007, was outrageous, and based in part on recommendations from a compensation consultant loyal to Mozilo rather than Countrywide.

Even so, Mozilo was bitter that the company did not give him everything he wanted. In an e-mail message turned up by the Oversight Committee, Mozilo wrote to the compensation consultant:

“I appreciate your input but at this stage in my life at Countrywide this process is no longer about money but more about respect and acknowledgement of my accomplishments. … Boards have been placed under enormous pressure by the left wing anti business press and the envious leaders of unions and other so called ‘CEO Comp Watchers’ and therefore Boards are being forced to protect themselves irrespective of the potential negative long term impact on public companies. I strongly believe that a decade from now there will be a recognition that entrepreneurship has been driven out of the public sector resulting in underperforming companies and a willingness on the part of Boards to pay for performance.”

With attention focused on the discrepancy between Mozilo’s compensation package and Countrywide’s well-being, he waived various payments – totaling $37.5 million – he could have received once Bank of America finalizes its takeover.

In March 2008, Mozilo appeared before the House Oversight Committee to explain his compensation.

“Countrywide’s board,” he testified, “has aligned the interests of our top executives, including me, with shareholders by making our compensation primarily performance-based – namely, tied to earnings per share and share price appreciation. Since 1982 through early 2007, Countrywide’s stock appreciated over 23,000 percent, reaching a peak market value of over $25 billion from a starting value of zero. As a result, over recent years, I have received substantial income from bonuses under a formula that was approved by our shareholders on at least two occasions.”

He also received substantial stock options, explaining, these were “options that required the price of the stock to rise above the option price before any income could be realized, thereby aligning me squarely with our shareholders.” In anticipation of his retirement, he testified, he put in place a plan to cash in some stock options earned in earlier years. His sales were thus planned in advance of Countrywide’s downturn. But he continues to hold substantial shares in Countrywide – shares worth much less than before the company’s stock collapsed.

Mozilo testified that he is “very proud of the home ownership opportunities that Countrywide has provided for over 20 million families,” while acknowledging the hardship faced by homeowners and Countrywide employees and shareholders.

“In my 55 years in the industry,” he said, “this by far is the worst housing crisis I have ever seen, combined with an unprecedented collapse of the credit and liquidity markets.”

“The problem we face,” he said, “is the deterioration of the value of homes. As values were going up, we had no problem. We had no delinquencies and no foreclosures, because people had options, because people run into three things in their lives generally – loss of job, loss of marriage, loss of health. When that happens and they own a home, and it impacts their income, they generally have a way out – sell the house, refinance, do something.

“That equity that they have in their homes has been virtually wiped out. And that’s what’s exacerbating this whole foreclosure problem.”

Wasn’t that problem entirely foreseeable? Didn’t Countrywide’s lending policies – which generously might be called aggressive – depend on constantly rising housing values in what was obviously a bubble market?
